Terms of Service

These Terms of Service ("Terms") govern your access to and use of orbitapps' Orbit Wifi platform, including our website at orbitapps.co.ke, our hotspot and PPPoE billing services, our admin/operator dashboard, and our mobile application (together, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
These Terms cover two kinds of Orbit Wifi users, with different rights and obligations described below: customers who pay to access WiFi through a hotspot or PPPoE connection run on the platform, and operators ("tenants") who use the Orbit Wifi platform to run their own hotspot or ISP business.

1. Agreement to Terms
In Short: Using the Services means you accept these Terms and our Privacy Policy.
By creating an account, connecting a router to the platform, purchasing internet access, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services on your own behalf.
2. Description of Services
In Short: Orbit Wifi is a platform for hotspot and PPPoE internet access billed through M-Pesa, operated by independent network operators.
The Services include, among other things:
- Pay-as-you-go hotspot WiFi access purchased via M-Pesa STK Push, activated instantly on payment
- Fixed-line PPPoE subscriber billing for wired internet connections
- Prepaid voucher codes as an alternative to phone-based payment
- An operator dashboard for managing routers, customers, packages, and payments
- A wallet system through which operators can request payouts of their earnings
Orbit Wifi provides the software platform and payment processing infrastructure. Individual hotspots and PPPoE networks are owned and operated by independent operators, not by orbitapps directly, unless we say otherwise for a specific location.
3. Eligibility & Accounts
In Short: You're responsible for your account and for keeping your login details secure.
Customer access to hotspot or PPPoE internet does not require creating an account — access is tied to your device and phone number for the duration you've paid for. Operator and staff access to the admin dashboard does require an account, created for you or by an administrator on your team.
You are responsible for maintaining the confidentiality of any login credentials issued to you and for all activity that occurs under your account. Notify us immediately at ronkdy1@gmail.com if you suspect unauthorized use of your account.
4. Payments & Billing
In Short: Payments are processed via M-Pesa. Purchased access is generally non-refundable once activated, except where required by law or approved case by case.
All customer payments are processed through Safaricom M-Pesa. By initiating a payment, you authorize the applicable charge to your M-Pesa account for the package or plan you selected. Prices are displayed in Kenyan Shillings (KES) and are set by the operator of the specific hotspot or network you're connecting to.
Because internet access activates immediately on payment, purchases are generally final and non-refundable. Where a payment was taken in error, was duplicated, or access was never actually granted due to a technical fault, contact us or the relevant operator's support channel — refund requests are reviewed and, where approved, processed back to the original M-Pesa number.
PPPoE subscribers are billed on a recurring basis according to the plan they're subscribed to. Non-payment may result in suspension of service until the account is brought current, as described in the "Termination & Suspension" section below.
5. Operator (Tenant) Terms
In Short: Operators are independently responsible for their own network, hardware, and customer relationships; Orbit Wifi provides the billing and management platform.
If you operate a hotspot or PPPoE network on the platform, you are responsible for:
- Owning, installing, and maintaining your own router hardware and physical network
- Setting lawful, accurate prices for the packages you offer
- Complying with all applicable Kenyan telecommunications and consumer protection law for your network
- Handling first-line customer support for your own users
Platform fees, if any, and the mechanics of wallet payouts are as communicated to you at onboarding or in your operator dashboard. We reserve the right to withhold or reverse a payout where we reasonably suspect fraud, a payment dispute, or a breach of these Terms.
6. Acceptable Use
In Short: Don't use the Services for anything illegal, abusive, or that damages the network for others.
You agree not to use the Services to:
- Violate any applicable law or regulation
- Interfere with, disrupt, or attempt unauthorized access to any router, account, or system on the platform
- Circumvent, disable, or otherwise interfere with any billing, rate-limiting, or security feature of the Services
- Transmit malware, spam, or engage in any activity that abuses network resources at the expense of other users
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
We may suspend or terminate access for any account or device reasonably believed to be violating this section, with or without notice.
7. Service Availability
In Short: We work to keep the network reliable but can't guarantee uninterrupted access.
Internet access depends on factors outside our control, including operator hardware, power availability, upstream connectivity, and third-party infrastructure (including Safaricom's M-Pesa platform for payments). We do not guarantee that the Services will be uninterrupted, error-free, or available at all times, and we are not liable for outages caused by factors outside our reasonable control.
8. Intellectual Property
In Short: The Orbit Wifi platform, software, and branding are our property or our licensors'.
The Services, including all software, design, text, graphics, and the "Orbit Wifi" name and logo, are owned by orbitapps or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our branding except as necessary to use the Services as intended.
9. Termination & Suspension
In Short: We may suspend or terminate access for breach of these Terms, non-payment, or misuse.
We may suspend or terminate your access to the Services, or a specific device's or account's access, at any time for violation of these Terms, non-payment, suspected fraud, or misuse of the network. Operators may have their own additional termination terms for their customers, communicated through their own channels.
You may stop using the Services at any time. Ending your use does not entitle you to a refund of amounts already paid, except as described in "Payments & Billing" above.
10. Disclaimers
In Short: The Services are provided "as is," without warranties beyond what the law requires.
To the fullest extent permitted by applicable law, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
11. Limitation of Liability
In Short: Our liability to you is limited to the amount you paid us in the recent past, to the extent the law allows.
To the fullest extent permitted by applicable law, orbitapps and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services. Our total liability to you for any claim arising from these Terms or the Services will not exceed the total amount you paid us in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms limits any liability that cannot legally be limited under Kenyan law.
12. Indemnification
In Short: You agree to cover our costs if your misuse of the Services causes us legal trouble.
You agree to indemnify and hold orbitapps harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Services, or your violation of any law or third-party right.
13. Governing Law & Disputes
In Short: These Terms are governed by the laws of Kenya.
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will first be addressed by contacting us directly to seek an informal resolution before either party pursues formal legal action, and will be subject to the exclusive jurisdiction of the courts of Kenya.
14. Changes to These Terms
In Short: We may update these Terms; continued use after changes means you accept them.
We may revise these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent changes. If we make material changes, we will make reasonable efforts to notify you. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
